Artist Sues The Game For Ripping Off His Photo For Album Single
Kevinn McNair Said The Game Used Instagram To Steal His Pic For His Single, “Ryda”; Suing The Rapper For Cash And To Immediately Stop Using The Photo
An unknown hip hop artist has accused The Game of stealing his photo to promote his new single, slapping the rapper with a copyright infringement lawsuit for a ton of cash.
A Florida hip hop artist named Kevinn McNair aka “Ariza Obey,” sued The Game last week in Florida’s U.S. District Court, accusing him of ripping off McNair’s photo of a topless woman straddling him as they brandish gold guns. McNair said The Game used the picture as the cover art for his single, “Ryda,” featuring Dej Loaf, for his new album, “The Documentary 2.”
McNair said that he is the owner of the copyright for a photo image “Ride or Die” that he helped create last year for his album, “Purge,” as well as a clothing line.
McNair explained in court papers that the photo got a bunch of traction on social media, with various celebrities re-posting his photo. It received several thousand likes on Instagram, and McNair said that’s where The Game stole it.
McNair said that The Game illegally used the photo in question for the album cover of the single, which was released on iTunes and various other outlets online. The song was a hit, making it to the Billboard charts and was viewed over nine million times on YouTube.
The Game, who was born Jayceon Taylor, never asked for permission to use the photo, nor did he pay a dime to McNair for using it in his promotion, McNair said in his court filing.
But McNair took credit for the single being such a hit, claiming his photo was the reason for it’s huge success. He also brought up the fact that The Game has been slapped with numerous lawsuits over the years accusing him of stealing other people’s work.
McNair demanded The Game immediately stop using his photo, monetary damages for the unauthorized use of his iconic photo and attorney fees for having to sue the rapper in court.
