Article Image: Troy Ave Avoids Murder Charge in Irving Plaza ShootingTroy Ave escaped the most serious charge in his case, as he will not be charged with murder in the NYC shooting at a T.I. concert. However, he's not in the clear, as he was indicted on five other felonies that could land him in prison for quite some time.
According to legal docs obtained by TMZ, a grand jury indicted Troy on one count of attempted second-degree murder and four counts of criminal possession of a weapon.
Troy's friend and bodyguard, Ronald McPhatter, was killed during the shooting last month.  Some suspected that Troy shot himself and his friend, something he has vehemently denied. Ballistic testing did not lead back to the weapon Troy was seen firing that night on video.
Troy has maintained that he is the victim and was defending himself. He also addressed it on his song “I’m Innocent”, which he released while he was in jail.
His attorney Scott Leemon tells TMZ, "The video does not show everything nor explain what happened in the VIP room before Troy came running out, as a victim, after he was shot."
Leemon says he will ask the judge to release Troy on bail this week at his next hearing.
